CDQ Obtains Summary Judgment Ruling

In 2018, a plaintiff sued CDQ’s clients, a public university and several of its employees and former employees, in federal court alleging multiple claims arising from his expulsion.  In December 2019, the District Court granted CDQ’s motion to dismiss several of the claims for failing to state a valid claim.  On May 17, 2021, following extensive discovery, the Court granted the public employees’ motion for summary judgment on the sole remaining claim against them for gross negligence.  Among other things, the Court held that tort duties did not arise out of the contractual relationship between the plaintiff and the university.   A great result through the efforts of Dan Dowd, Betsy Lamm, Rebecca van Doren, and Jenna Brownlee.
