Arizona Court of Appeals Affirms Judgment in Favor of CDQ’s Clients
On March 2, 2023, the Arizona Court of Appeals, Division One, issued a memorandum decision affirming the Maricopa County Superior Court’s entry of Judgment in favor of CDQ’s clients on myriad tort claims relating to the plaintiff’s expulsion as a member of the Arizona House of Representatives. Betsy Lamm argued the appeal, which involved complex issues of legislative immunity and political questions. The Court agreed with CDQ’s position that the political question doctrine bars plaintiff’s claims against CDQ’s clients.

On September 18, 2023, the Arizona Supreme Court denied the plaintiff’s petition for review, bringing this protracted litigation to conclusion, with CDQ’s clients prevailing on all claims against them.
