CDQ Obtains Favorable Settlement in Dispute Relating to Management Agreement

CDQ’s Daniel P. Quigley and Kevin C. Moyer represented a company in connection with litigation against a third party arising out of, among other subjects, the third party’s repudiation of multiple agreements with CDQ’s client, including a management services agreement.  After CDQ’s client filed a lawsuit in Maricopa County Superior Court, the third party moved to dismiss on a host of legal grounds, each of which was rejected.  CDQ thereafter successfully pursued an aggressive case schedule, in which the bulk of the matters at issue in the litigation were scheduled to be resolved by a bench trial in just several months.  A week in advance of when depositions were set to begin, the third party approached CDQ’s client regarding settlement.  CDQ thereafter assisted CDQ’s client in securing a favorable settlement result, in which CDQ’s client was able to obtain ownership and control of the underlying business it was originally under contract to manage under the management services agreement.
