CDQ’s Client Prevails In Appeal From Administrative Decision
CDQ represented Kim Bennet Farm, L.L.C. (“KBF”) in connection with a special action appeal from a decision of the Cochise County Board of Supervisors of Cochise (the “Board”). Dan Quigley, Neil Stuart and Kevin Moyer represented KBF on the appeal from the Board’s decision to grant a Special Use Permit to cultivate cannabis at a property located in Willcox, Arizona. On appeal, the plaintiff (a neighboring cannabis cultivator) sought to overturn the Board’s decision, arguing the Board violated Arizona’s Open Meeting Laws and acted beyond its authority. Adopting KBF’s arguments, the Court affirmed the Board’s decision and dismissed the complaint with prejudice.
